Dowd Scheffel Files Amicus Brief in Glaxosmithkline

December 22, 2020: Dowd Scheffel filed an amicus brief in Glaxosmithkline, LLC v. Teva Pharmaceuticals USA, Inc before the Federal Circuit. The amicus brief was filed on behalf of fifty-seven law, economics, business, health and medicine professors. The brief outlines how the panel majority in the case did not follow its own precedent in holding that corporations engaging in skinny labeling could be held liable for inducing patent infringement. This reduction of generic competition undermines the regulatory regime of the pharmaceutical industry. The amicus brief can be read here.
