Matthew Dowd files Brief in Supreme Court case Helsinn Healthcare SA v. Teva Pharmaceuticals
Mr. Dowd drafted and filed an amicus brief in an important Supreme Court patent case, Helsinn Healthcare SA v. Teva Pharmaceuticals USA Inc. The cert petition presents the question of "whether, under the Leahy-Smith America Invents Act, an inventor’s sale of an invention to a third party that is obligated to keep the invention confidential qualifies as prior art for purposes of determining the patentability of the invention." Mr. Dowd filed the amicus brief on behalf of The Naples Roundtable, a leading intellectual property organization founding by Judge Richard Linn. The amicus brief can be read here.
