Court Rules in Favor of Dowd Scheffel Client New Vision Gaming & Development

May 13, 2021: In a major victory for Dowd Scheffel, the U.S. Court of Appeals ruled in favor of New Vision Gaming & Development. The court’s decision is available here. The New Vision Gaming case was a closely watched appeal that raised in an important question about constitutional due process violations based on structural bias associated with the decisionmaking process of the Patent Trial and Appeal Board. Matthew Dowd argued the appeal before the appeals court panel of Judges Newman, Moore, and Taranto. The panel reversed the decision of the U.S. Patent and Trademark Office based on the Federal Circuit’s decision in Arthrex, Inc. v. Smith & Nephew, Inc. The decision received coverage in Patently-O, Law360, Reuters, and Bloomberg Law, among other places.
